Reconciling the constitutional principles of minimum public service and the right to strike

France’s laws on social dialogue of August 21, 2007 and March 19, 2012 attempt to reconcile two constitutional principles: the right to strike and minimum public service. Interpretations of what the law does and doesn’t say, and certain practices, are calling into question the benefits of the law and indeed its purpose. These include wrongful use of the right to withdrawal, calls for strike action with no strike, very short sick leave, and multiple short strikes rather than one long one. Should legislation be changed to improve passenger information and make it easier to maintain service during industrial action?
